Please read these Terms and Conditions ("Terms") carefully before using the RapidSell mobile application (the "App") operated by RapidSell ("we", "our", or "us").

By using the App, you agree to be bound by these Terms. If you do not agree, please do not use the App.

1. Use of the App

RapidSell is a mobile application that helps you create and manage product listings across multiple marketplaces using AI-powered tools.

To use the App, you must:

• Be at least 16 years of age
• Create an account with accurate information
• Keep your login credentials secure
• Comply with all applicable laws and regulations

2. Account

You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account.

We reserve the right to suspend or terminate your account if you violate these Terms or engage in fraudulent or harmful activity.

3. Credits and Payments

Certain features of the App require credits. Credits may be earned, purchased, or provided as part of a subscription plan.

• Credits are non-transferable and non-refundable unless required by law.
• We reserve the right to change credit pricing and allocation at any time.
• Unused credits do not expire unless your account is terminated.

4. AI-Generated Content

The App uses artificial intelligence to generate listing titles, descriptions, pricing suggestions, and image enhancements. You acknowledge that:

• AI-generated content is provided as a suggestion and may not always be accurate.
• You are solely responsible for reviewing and approving all content before publishing.
• We do not guarantee the accuracy, completeness, or suitability of AI-generated content.
• You are responsible for ensuring that published listings comply with marketplace rules and applicable laws.

5. Marketplace Integrations

The App allows you to connect and publish listings to external marketplaces. You acknowledge that:

• Each marketplace has its own terms of service that you must comply with.
• We are not responsible for actions taken by marketplaces on your listings or account.
• We do not guarantee that listings will be accepted or remain active on any marketplace.
• You can disconnect marketplace accounts at any time through the App.

6. Acceptable Use

You agree not to use the App to:

• List prohibited, illegal, or counterfeit items
• Misrepresent the condition, origin, or nature of products
• Infringe on the intellectual property rights of others
• Manipulate or abuse the AI features or credit system
• Interfere with or disrupt the App or its infrastructure
• Attempt to access other users' accounts or data

7. Intellectual Property

The App and its original content, features, and functionality are owned by RapidSell and are protected by copyright, trademark, and other intellectual property laws.

You retain ownership of the photos and content you upload. By using the App, you grant us a limited license to process your content for the purpose of providing the service.

8. Limitation of Liability

To the fullest extent permitted by law:

• The App is provided "as is" and "as available" without warranties of any kind.
• We are not liable for any indirect, incidental, special, or consequential damages.
• We are not responsible for any losses resulting from marketplace transactions, AI-generated content, or third-party services.
• Our total liability shall not exceed the amount you have paid us in the 12 months preceding the claim.

9. Termination

You may stop using the App and delete your account at any time. We may also terminate or suspend your access if:

• You violate these Terms
• Your use of the App poses a risk to other users or our infrastructure
• We are required to do so by law

Upon termination, your right to use the App ceases immediately. We may delete your data in accordance with our Privacy Policy.

10. Changes to These Terms

We may update these Terms from time to time. We will notify you of any changes by updating the "Last updated" date at the top of this page. Continued use of the App after changes constitutes acceptance of the updated Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to conflict of law provisions.
